Terms and Conditions

Welcome to Ubuntu Adventures! These terms and conditions ("Terms") govern your use of the Ubuntu Adventures website (the "Site") and any services provided by Ubuntu Adventures ("Services"). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree with these Terms, you should not access or use the Site or Services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Ubuntu Adventures, located at 12 Robben Island Drive, Cape Town, 7441, South Africa. Ubuntu Adventures is operated by Imbizo Travel Ltd., registered under company number 2015/123456/07. By using our website and services, you confirm that you are at least 18 years old or have the necessary legal capacity to enter into this agreement. Your continued use of this Site after any changes to these Terms are posted will constitute your acceptance of such changes. It is your responsibility to review these Terms periodically for updates. If you are using the Site or Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the Site.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site and its content for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Site in breach of these Terms, your right to use the Site will stop immediately and you must, at our option, return or destroy any copies of the materials you have made.

Ubuntu Adventures’ name, the Ubuntu Adventures logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Ubuntu Adventures or its affiliates or licensors. You must not use such marks without the prior written permission of Ubuntu Adventures. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

4. Limitation of Liability

To the fullest extent permitted by applicable law, Ubuntu Adventures shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Ubuntu Adventures has been advised of the possibility of such damages), resulting from:

Ubuntu Adventures does not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or other harmful components. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and data accuracy, and for maintaining a means external to our site for any reconstruction of any lost data.

Our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Ubuntu Adventures for the Services during the term of the agreement.

5. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. You agree that any legal action or proceeding between you and Ubuntu Adventures relating to these Terms or the Site shall be brought exclusively in the courts located in Cape Town, South Africa.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in full force and effect.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Ubuntu Adventures’ failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
